AND REALLY WHAT HE'S DONE IS HE'S, HE'S MADE IT FLOW EASIER.

AND SO WHEN RESIDENTS LOOK AT THIS ZONING ORDINANCE HE'S EVEN PUT IN SOME PICTURES OF SETBACKS. SO LIKE YOU'LL SEE A RESIDENTIAL HOUSE WITH A FENCE AND MAYBE A POOL AND AN ACCESSORY BUILDING AND IT'LL HAVE SETBACK REQUIREMENTS.

AND SO IT JUST MAKES IT EASIER TO WORK THROUGH IT.

WE'VE BEEN AROUND FOR A COUPLE OF YEARS NOW.

WE GOT A COMPREHENSIVE PLAN DONE LAST YEAR, AND TIM, BEFORE HE GRACIOUSLY RETIRED HELPED US GET ON BOARD TO HELP YOU START IMPLEMENTING THAT COMPREHENSIVE PLAN. AND ONE OF THE BIGGEST TOOLS OF THE COMPREHENSIVE PLAN TO BE ABLE TO IMPLEMENT IS UPDATING YOUR ZONING ORDINANCE AND YOUR SUBDIVISION ORDINANCE, OR ARE TWO SEPARATE ORDINANCES IN YOUR CODE OF ORDINANCES THAT REALLY DEAL SPECIFICALLY WITH DEVELOPMENT. AND SO NOW WE'VE KIND OF DONE SOME MODIFICATIONS TO ORDINANCES, AND WE'LL KIND OF GO THROUGH SOME OF THE MAJOR CHANGES THAT WE'VE DONE THROUGH THE PROCESS. WE'VE BEEN REGULARLY MEETING WITH YOUR PLANNING AND ZONING COMMISSION.

IT'S KIND OF USING THEM AS OUR STEERING COMMITTEE AND ASKING THEM QUESTIONS ABOUT THINGS THAT THEY WANT TO SEE, MAKE MODIFICATIONS.

ONE OF THE BIGGEST THINGS THAT WE HEARD FROM THE VERY ONSET WAS THAT, LIKE BLAKE TALKED ABOUT, WE WANT TO MAKE SURE THAT THIS ORDINANCE IS USABLE NOT ONLY FOR THE APPLICANTS.

SO THEY COME IN AND SAY, OKAY, THIS IS HOW WE'RE GOING TO DEAL WITH THINGS IN THE CITY OF HUTCHINS, BUT IT'S ALSO GOING TO BE GOOD FOR YOUR STAFF. WE WANT YOUR STAFF TO BE ABLE TO USE YOUR ORDINANCE AND SAY, THIS IS WHAT WE WANT, HOW WE CAN GO AHEAD AND GET IT.

AND THAT'S THAT. YOU KNOW, THAT'S A BIG PART OF TRYING TO MAKE LEGAL DOCUMENTATION ACCESSIBLE FOR PEOPLE AND BEING ABLE TO BE UTILIZED.

WE WANTED YOU TO MAKE SURE THAT YOU HAD AN OPPORTUNITY TO KIND OF READ THROUGH THESE ORDINANCES, TAKE A LOOK AND GIVE US SOME MORE FEEDBACK AS WE GO THROUGH IT.

WE'RE GOING TO BE ALSO MAKING SURE THAT YOUR ATTORNEY TAKES A LOOK AT THESE ORDINANCES, BECAUSE ONE OF THE BEST THINGS IS THAT YOU ALLOW PROFESSIONALS TO READ THROUGH AND WRITE ORDINANCES TO HELP YOU THINGS OUT.

WE WANT TO MAKE SURE THAT THERE IS A STREAMLINED APPROVAL PROCESS AND TIMELINES.

WE NEED TO MAKE SURE THAT YOUR TIMELINES FOR APPROVAL FOR ZONING CASES, SITE PLANS, BUT SPECIFICALLY FOR YOUR PLATS, THE CREATION OF SUBDIVISIONS IN YOUR COMMUNITY, MEET THE STANDARDS OF STATE LAW BECAUSE STATE LAW IS VERY SPECIFIC OVER THE LAST SEVERAL LEGISLATIVE SESSIONS ON HOW MUCH TIME YOU HAVE TO BE.

ABLE TO SUBMIT SOMETHING, GET IT REVIEWED AND THEN GET IT BEFORE YOUR PLANNING AND ZONING COMMISSION AND YOURSELVES FOR APPROVAL.

WE ALSO NEED TO MAKE SURE THAT THERE IS BETTER ALIGNMENT BETWEEN YOUR ZONING DISTRICTS, THE SEPARATION OF EACH OF THE TYPES OF LAND USES AND THE KINDS OF LAND USES THAT ARE AVAILABLE. YOU HAD A LOT OF DIFFERENT USES, SOME OF WHICH ARE NO LONGER BEING USED.

WE DON'T HAVE VIDEO RENTALS PLACES ANYMORE.

SO WE KIND OF TOOK OUT SOME OF THOSE TYPES OF USES AND WE PUT IN AND CONSOLIDATED SOME OF THE USES TOGETHER. WE HAD A LOT OF DIFFERENT KIND OF MANUFACTURING IN THERE.

WE PUT THOSE TOGETHER AS SIMILAR TYPES OF USES.

WE DON'T WANT TO PUT ANY OF YOUR EXISTING BUSINESSES OUT OF SHAPE WITH YOUR ZONING ORDINANCE. SO WE MADE SURE WE TRIED TO DO OUR BEST TO MAKE SURE THEY STILL FIT IN WITH THOSE ZONING DISTRICTS, ESPECIALLY IN YOUR INDUSTRIAL ZONING DISTRICT. BUT WE WANTED TO MAKE THINGS MUCH MORE MODERN, CONCISE, AND USER FRIENDLY.

THERE'S NO CHANGE IN THEM.

SO WHEN WE TALK ABOUT LAND USES, WE'VE GOT, YOU KNOW, IF YOU'VE GOT MANUFACTURING THIS AND MANUFACTURING THAT AND MANUFACTURING THE THIRD, THERE'S SEVERAL DIFFERENT ONES THAT ARE ALL CONSIDERED AS MANUFACTURING.

WE ARE WE ALIGNED IT FOR THREE ARTICLES.

THE STRUCTURE FOR THE WORKFLOW, AND WE WANTED TO MAKE SURE THAT THERE WAS A CLEAR PROCESS FOR THE CREATION OF SUBDIVISION PLATS IN THE COMMUNITY.

BECAUSE THE WORST THING IS THEY COME IN WITH AN APPLICATION THAT'S HALF FILLED OUT, AND THEN YOU HAVE TO SAY, OH, IT'S NOT RIGHT.

WE NEED YOU TO GO BACK AND TRY AGAIN.

SO WE WANT TO TRY AND MAKE THE DEVELOPMENT PROCESS THOROUGH AND RIGOROUS.

RIGOROUS BUT NOT DEMONSTRABLY AGAINST DEVELOPMENT.

WE WANT IT TO BE THAT GOOD WORKING RELATIONSHIP BETWEEN DEVELOPERS AND PROTECTING THE CITY. SO AS PART OF THAT WE ALSO MADE SURE THAT WE MADE COMPLIANCE WITH STATE LAW ON ALL OF YOUR PRELIMINARY AND FINAL PLAT, YOUR APPLICATION SUBMITTAL TIMES.

THERE'S A 30 DAY SHOT CLOCK BETWEEN THE FORMAL ACCEPTANCE OF A PLAT AND THEN THE APPROVAL PROCESS. AND IF THAT PLATS NOT NOT READY TO GO, TAKE IT BEFORE YOUR PLANNING AND ZONING COMMISSION TO DENY IT SAYING X, Y, AND Z ARE NOT CORRECT BY OUR ORDINANCE NUMBERS AND GO AND TRY IT AGAIN AND RESUBMIT.

WE ALSO MADE SURE THAT THERE WAS ACCOUNTABILITY FOR WHO IS GOING TO APPROVE WHAT IN YOUR ORDINANCE, AND WE MADE THAT VERY, VERY CLEAR. THERE ARE CERTAIN TYPES OF PLANTS THAT DO NOT NEED TO BE COMING BEFORE YOU PRELIMINARY AND FINAL PLATS, NEW DEVELOPMENT REPLANTS NEW DEVELOPMENT AND SUBDIVIDING THAT AFFECTS YOUR MAY AFFECT YOUR COMMERCIAL PROPERTY AND YOUR RESIDENTIAL PROPERTY. THOSE ABSOLUTELY NEED TO COME BEFORE YOU.

BUT IF IT'S A MINOR PLAT, YOU'VE GOT A LOT THAT IS GOING TO BE SPLIT INTO FOUR LOTS OR LESS AND DOESN'T PUT ON ANY ADDITIONAL ROADS.

THERE'S NOT GOING TO BE ANY ADDITIONAL DEDICATION AND IT DOESN'T MESS WITH ANY EXISTING COVENANTS. THEN LET'S GET THAT APPROVED BY YOUR ADMINISTRATIVE STAFF.

THEY REVIEW IT, MAKE SURE THAT IT MEETS THE MINIMUM STANDARDS OF YOUR ZONING APPROVAL BY STAFF. ANOTHER TYPE OF PLAT IS A AMENDING PLAT.

SOMETIMES PROFESSIONALS MAKE MISTAKES.

AND ONE OF THOSE THINGS THEY DO IS A CALL LINE.

YOU KNOW HOW MUCH YOUR DISTANCE IS, IS INCORRECT ON A RECORDED PLAT.

AND THEY HAVE TO COME BACK AND AMEND THAT PLAT IN ORDER FOR TITLE WORK TO GO THROUGH AND SELL THE PROPERTY.

THOSE KINDS OF AMENDMENTS HAVE TO COME THROUGH STAFF AND LET THEM TAKE A LOOK AT IT.

AND THOSE ARE THOSE CAN BE EASILY ADMINISTRATIVELY APPROVED.

WE ALSO MADE SURE THAT WE LOOK AT THE TECHNICAL STANDARDS OF YOUR PLATS AND MAKE SURE THE UPDATED SUBMISSION FORMATS.

THERE'S SOME NEW STATE LAWS THAT REQUIRE THERE TO UTILIZING GROUNDWATER THAT WE HAVE TO MAKE SURE THAT THERE IS A CERTIFICATION BY A LICENSED ENGINEER, THAT GROUNDWATER AVAILABILITY IS ACCEPTABLE FOR THAT PARTICULAR LOCATION.

WE WANTED TO MAKE SURE THAT THERE IS EXEMPTIONS REMOVED AND PLATTING APPLICABILITY

YOU HAVE A LARGE LOT AND YOU WANT TO SUBDIVIDE IT FURTHER, BUT IT'S IN A RESIDENTIAL SUBDIVISION.

PREVIOUSLY, YOU HAD TO HAVE A PUBLIC HEARING.

WELL, THE STATE DOESN'T REQUIRE A PUBLIC HEARING ANYMORE, BUT IT REQUIRES THAT YOU HAVE A NOTICE TO THE SURROUNDING PROPERTY OWNERS WITHIN 200FT OF THAT SAME SUBDIVISION AFTER IT'S BEEN APPROVED.

SO YOUR REPLAT STILL HAS TO MEET ALL OF YOUR ZONING REQUIREMENTS, STILL HAS TO MEET ALL OF YOUR ENGINEERING REQUIREMENTS FOR THEM TO SUBDIVIDE A LOT.

FOR RESIDENTIAL PURPOSES INTO A AND TO FURTHER SMALLER LOTS.

BUT THERE DOES NOT REQUIRE A PUBLIC HEARING.

UNLESS THERE'S A VARIANCE, THEN THEY HAVE.

YOU STILL HAVE TO HAVE A PUBLIC HEARING, BUT THOSE ARE VERY FEW AND FAR BETWEEN.

BUT THAT PROCESS HAS BEEN INCLUDED.

ONE OF THE OTHER BIG ASPECTS I WANTED TO ALSO TALK ABOUT IN YOUR SUBDIVISION ORDINANCE THAT WASN'T THERE PREVIOUSLY IS WE ADDED SOME LANGUAGE ABOUT THE DEDICATION OF, OF OF ITEMS FOR THE COMMUNITY.

IF YOU HAVE TO REQUIRE THE DEDICATION OF, OF PARKS, IF YOU DEDICATION OF UTILITY EASEMENTS, THE DEDICATION OF PUBLIC ROADS, ALL OF THAT IS REQUIRED BY FEDERAL STANDARDS TO BE HAVE A RATIONAL NEXUS TO BE A ROUGH PROPORTIONALITY. THESE ARE VERY SPECIFIC FEDERAL TERMS THAT SAY THAT IF YOU'RE GOING TO BE DEDICATING PRIVATE PROPERTY FOR THE PUBLIC USE IN CREATING A SUBDIVISION.

AND MOST SUBDIVIDERS AND DEVELOPERS UNDERSTAND THIS, THEN THERE HAS TO BE A RELATIONSHIP FOR THE AMOUNT OF PROPERTY THAT YOU'RE DEDICATING TO THE IMPACT THAT YOU'RE DOING.

FROM BRINGING IN NEW DEVELOPMENT INTO THE COMMUNITY.

AND IF YOU FEEL THAT YOU ARE THAT THE CITY IS TAKING TOO MUCH, THEN THERE HAS TO BE A PROCESS IN ORDER TO APPEAL TO THAT PROCESS.

ALSO LOOKING AT SOME OF THE DESIGN STANDARDS FOR THOSE HOUSING TYPES SO THAT WE CAN HOPEFULLY ENSURE GOOD PROPERTY DESIGN AND WE WANT TO MAKE IT USER FRIENDLY.

ONE OF THE BIGGEST THINGS ABOUT THAT IS BEING ABLE TO LOOK AT A PROPERTY, UNDERSTAND FROM YOUR ZONING MAP WHAT THAT PROPERTY IS ZONED, GO TO YOUR ZONING ORDINANCE, FIND THE ZONING DISTRICT.

WHAT ARE THE STANDARDS FOR THAT ZONING DISTRICT? LOOK AT THE PERMITTED USE TABLE SAYING, I'M GOING TO PUT A BRAND NEW CAR DEALERSHIP IN THAT ZONING DISTRICT OR A GROCERY STORE IN THAT ZONING DISTRICT, AND WHICH IS A HOPEFUL ASPECT FOR THE CITY OF HUTCHINS.

AND THAT IS ONE OF OUR ASPIRATIONS THAT WE WANTED TO PUT INTO OUR COMPREHENSIVE PLAN.

SO YOU LOOK AT THIS IS WHERE WE'RE GOING TO DO THAT, AND WE DEFINE WHAT THE GROCERY STORE IS AND YOUR DEFINITIONS.

AND THEN WE ALSO PUT IN THE SAME EXACT LANGUAGE INTO YOUR PARKING STANDARDS.

ONE OF THE THINGS THAT WE REALLY WANTED TO DO IS PUT ALL OF YOUR OTHER GENERAL PROVISIONS

IF Y'ALL HAVE ANY QUESTIONS FOR HIM, THE PROGRESS AND THE STATUS OF THAT PROJECT, WHICH IS, WHICH WAS ORIGINALLY GOING TO BE TEN BUILDINGS, THEY HAD TO PULL OUT A LOT OF DIRT. AND THROUGH THAT PROCESS, THEY THE COMMISSIONER WILL NOT LET THEM DRIVE BIG TRUCKS DOWN THERE TO PUT THE DIRT BACK.

IT IS LIKE A TAKING A SPOON AND PUTTING IT FROM A BUCKET OF WATER INTO A LAKE. WE HAVE TEN YARD TRUCKS AND ORIGINALLY, AT THE VERY BEGINNING WHEN WE PULLED THE PERMIT, NOBODY THOUGHT THAT WE WERE GOING TO HAVE ISSUES GETTING DOWN THAT ROAD WITH THE 50,000 POUND LIMIT. OF COURSE, IT TAKES THE N DUMPS, WHICH ARE THE 20 YARD TRUCKS THAT WE NEED, AND THOSE WERE GOING IN THERE JUST FINE GOING IN. BUT NOW, OF COURSE, THE COMMISSIONER STOPPED US WITH THE THE SIZE OF THE TRUCKS GOING IN THERE. SO NOW WE'RE DOWN TO THE TEN YARD TRUCKS WE HAVE NEGOTIATED WITH COMMISSIONER WITH THE COUNTY BRIDGE AND ROAD.

ROGER. I'VE SPENT A LOT OF TIME WITH HIM AS FAR AS TRYING TO GET IN THERE AND SAY, CAN WE WORK OUT A DEAL? AND WE DID COME UP WITH A DEAL, BUT IT'S STILL STUCK IN PAPERWORK.

COMMISSIONERS SAID YES TO THE AMOUNT THAT WE CAN DO OF ACTUALLY PAYING FOR THE ROAD TO BE OVERLAID FROM THE COUNTY PART TO THE DUMP SITE.

THAT'S AT OUR EXPENSE.

BUT WE WOULD PUT THAT MONEY IN ESCROW WITH THE COUNTY WHERE THEY WOULD HOLD THAT MONEY UNTIL WE GET READY TO.

WE TOLD THEM, WAIT A YEAR BECAUSE YOU DON'T WANT TO TEAR UP THE ROAD.

THAT WOULD GIVE US TWO MONTHS TO BASICALLY FILL IN THE HOLE, DO OUR COMPACTION, WHICH OUR ENGINEER THAT WE HIRED IS THE SAME ENGINEER, RANDY FROM HELMBERGER HERE.

SO THEY'RE GOING THROUGH SOME MANEUVERS OF WHERE THEY'RE HAVING TO CHANGE THEIR CHARTERS AND THINGS LIKE THAT THEY'RE DOING BUSINESS WISE, BUT THEY ARE AND THEY MOVED THEIR OFFICES OVER THE HOLIDAYS UP INTO ADDISON FROM OFF THE DALLAS NORTH TOLLWAY, FROM ADDISON TO PLANO.
